Distance Sales Agreement

This Distance Sales Agreement is concluded electronically between the SELLER and the BUYER identified below, under Turkish Consumer Protection Law no. 6502 and the Distance Contracts Regulation.

This is an English translation provided for convenience. In the event of any discrepancy, the Turkish text is the legally binding version.

Article 1 — Parties

The name, delivery and invoice address, phone number and email address given by the BUYER at the time of order appear in the order summary, which forms an integral part of this agreement.

Article 2 — Subject

The subject of this agreement is to define the rights and obligations of the parties in relation to the sale and delivery of the product ordered electronically by the BUYER from the SELLER's website muenka.com, the characteristics and sale price of which are set out in the order summary.

Article 3 — Product

The type, quantity, brand/model, colour and sale price of the product are as stated in the order summary. VAT is included in the price. For deliveries within Türkiye, shipping is covered by the SELLER.

Article 4 — General provisions

4.1 The BUYER declares that they have read and understood the preliminary information on the website regarding the essential characteristics, sale price, payment method and delivery of the product, and have given the necessary confirmation electronically.

4.2 The product is handed to the courier within 1-4 business days following confirmation of the order and payment; the statutory maximum delivery period is 30 days.

4.3 Where the product is to be delivered to a person or organisation other than the BUYER, the SELLER cannot be held responsible if that person or organisation refuses delivery.

4.4 The SELLER is responsible for delivering the product intact, complete and in accordance with the characteristics stated in the order.

4.5 If, after delivery, the BUYER's credit card is used without authorisation through no fault of the BUYER and the bank or financial institution therefore does not pay the product price to the SELLER, the product must be returned to the SELLER within 3 days.

4.6 If the SELLER cannot deliver on time due to force majeure or extraordinary circumstances preventing transport, the SELLER shall inform the BUYER. In that case the BUYER may request cancellation of the order, replacement with an equivalent product, or postponement of delivery. If the order is cancelled, the amount paid is refunded within 14 days.

Article 5 — Right of withdrawal

The BUYER may withdraw from the contract within 14 days of delivery of the product to themselves or to the person at the address they indicated, without giving any reason and without paying a penalty. To exercise this right, written notice must be given to the SELLER within this period and the product must be unused.

Withdrawal notices may be sent to info@muenka.com. Where the right is exercised, the product must be returned to the SELLER's address with all tags attached and in its original packaging. Return shipping is covered by the SELLER. The price is refunded to the BUYER within 14 days of the product reaching the SELLER.

Article 6 — Cases where the right of withdrawal does not apply

Under Article 15 of the Regulation, the right of withdrawal cannot be exercised for products prepared to the BUYER's specifications or personal requirements, for products whose packaging has been opened after delivery and whose return is not suitable for reasons of health and hygiene, and for products that by their nature cannot be returned.

Without prejudice to the right of withdrawal, exchange requests for discounted items within a campaign are met as exchanges only.

Article 7 — Dispute resolution

Up to the value announced by the Turkish Ministry of Trade, Consumer Arbitration Committees at the place of residence of the BUYER or the SELLER have jurisdiction; above that value, Consumer Courts have jurisdiction.

Article 8 — Entry into force

By confirming an order on the Site, the BUYER is deemed to have accepted all terms of this agreement. The agreement enters into force upon the SELLER's confirmation of the order.
